Client suffers injury at work after attack by patient

Our client was employed as a nurse and was attacked by a patient during the course of her employment on the 20th March 2008. As a result of the accident, she sustained an acceleration of her pre-existing knee condition. The defendants initially denied liability for the incident and upon issue put forward a split liability offer. The matter proceeded by way of Court directions. Following the exchange of witness statements and updated medical evidence, parties entered into negotiation settlements. The Claimant expert was of the view the incident had accelerated our clients pre-existing knee condition by a period of 5-10 years. The defendants sought to obtain their own medical evidence. Our client had not suffered any loss of earnings. An initial offer of £4,000 was rejected and following further negotiations, the claim was settled in the sum of £10,000.00 with no further arguments of contributory negligence.
