Incorrect information regarding maternity leave entitlements left client in financial hardship

14 June 2011

Our client was provided with incorrect information about her maternity leave entitlements and relied upon these when saving for her period of maternity leave. She was told incorrectly that she would receive maternity pay at 90% of salary.  On the date when she expected to begin to receive that amount, her pay was in fact reduced to a lower rate of maternity pay. This was the correct amount in her circumstances but she had not budgeted for it, causing her financial hardship.  Proving financial loss in this case was problematic because the detriment experienced by the client as result of her reliance upon the incorrect information was very difficult to quantify from a financial perspective. The claim eventually settled and was an important result financially for our client.
