Client who returned to work after maternity leave faced redundancy

27 May 2011

We acted for a lady who, following her return from maternity leave, was not given her work back and was then told she was being made redundant. During her absence on maternity leave new people had joined her team and her maternity leave cover remained in place. The employer had not demonstrated that it had followed a fair selection process, instead targeting our client because they said she had no work to do. With our help our client challenged the decision through the redundancy process and then through an appeal. Following the outcome of the appeal we had to threaten litigation but ended up achieving a good settlement for our client before having to issue proceedings.
