Grandparent’s Application for Residence

After it has been widely reported that there will be an extension to Grandparent’s rights in respect of their Grandchildren, we have recently dealt with a case at Court, whereby we were representing maternal Grandparent’s and their application for a Residence Order in respect of their 3 month old Granddaughter.

The Father was not on the scene and the Mother had been involved with Social Services when the child was born as a result of concerns regarding the Mother’s ability to provide for her daughter. The Mother was considered to be a flight-risk and there were issues in respect of the child’s welfare and safety.

Social Services prepared a report recommending Residence to our clients to which the Mother did not object.

Outcome: Residence granted to the Grandparents at the first hearing and permission was not required from the Court to make the application in the first instance.
