Client's wife removed children from Spain without consent

08 April 2011

Our client was resident in Spain with his family. The marriage broke down and the wife removed the children from Spain without our client's consent. We were able to advise our client that he could issue an application under the Hague Convention to seek the return of the children and seek publicly funded legal assistance. As we do not offer publicly funded legal assistance the client was referred to another firm but as he was so impressed with the advice provided, the client returned to RJW when divorce and ancillary relief proceedings were issued in England. The Wife sought to include her legal costs from the Hague Convention proceedings, which at FDR it was indicated she would not be successful.
