Challenge to injury on duty pension

02 March 2011

We brought a judicial review challenging a reduction in our client's injury on duty pension from a band 4 to a band 2 by the Selected Medical Practitioner and the Police Medical Appeal Board. We argued in light of the Court of Appeal decision in Laws that there had not been a sufficient change in our client's degree of disablement to justify the reduction made. The Police Authority agreed to quash the decision of the SMP and PMAB and reinstate the client in a band 4 and pay him £23,000 by way of back payments for his reduced pension in the meantime together with our legal costs.  This was a good result as we considered (and counsel advised) that the claim was by no means clear cut.
