Baby Xavier Cutillo’s Parents Seek Medical Negligence Compensation
19 October 2010
The Portogallo family is seeking compensation from the NHS after their son was blinded in one eye during birth. Xavier Cutillo was delivered using forceps in late 2009. The negligent use of these forceps meant that his eye ball was seriously injured and his skull fractured. Northern Lincolnshire & Goole Hospital’s NHS Foundation Trust has admitted full liability, and have changed its birthing policy and practices since the incident. RJW’s expert birth injury solicitors are working closely with the Portogallo family to ensure that full compensation is recovered for Xavier, to cover future treatment and care. James Bell, Partner at Russell Jones and Walker who are representing the couple, said: “The doctors failed to inform Emma of their treatment plan and failed to obtain consent to for a forceps delivery. This is completely unacceptable practice."
