Successful HSE investigation defence in Hatfield train derailment case

Our London Business Crime & Regulation team successfully defended a Regional Manager of Balfour Beatty who was subject to an HSE investigation and faced charges of gross negligence manslaughter and health and safety breaches arising from the Hatfield train derailment. The court accepted that his position was not sufficiently senior within the structure of the company for him to be said to be the controlling mind of the organisation.

Following submissions at the close of the prosecution case the Judge directed not guilty verdicts to the allegations of gross negligence manslaughter. Our client was subsequently acquitted by the jury of any health and safety breaches.
