PHI and Share Incentive Schemes

We acted for a senior executive in a complex health insurance and disability discrimination claim against a large employer. Our client was signed off long-term sick due to stress but did not receive the allocation of shares he was entitled to under an incentive scheme while he was in receipt of PHI benefits, because the employer argued that he could be treated as if his employment had ended. We achieved a considerable settlement for our client and an improvement to his monthly payment under the PHI contract.
