45 year old woman wrongly diagnosed with breast cancer

11 January 2007

In one of our medical negligence claims, a 45 year old woman was wrongly diagnosed with breast cancer. She underwent a biopsy which was wrongly reported to be positive when in fact it was negative. The lump was then surgically removed and lymph nodes were also removed from her armpit. This left her with scarring, a cosmetic deformity of her breast, an altered sensation in her arm and some restriction in her arm movements. She was also at risk of developing lymphadenopathy of the arm in the future. Our expert medical negligence claims solicitors settled the case for £17,500 of which £12,500 was awarded for the injuries. The level of damages was significantly higher than previous cases suggested and it is hoped that this will set a precedent for future awards.
