Interim Payments - Head Injury Compensation

Interim Payments allow you to receive part of your compensation settlement before the final judgement is reached. However, Interim Payments are only available when liability has been admitted by the other side, but the money can pay for private medical treatments, if required, pay for rehabilitation support and equipment, to adapt living accommodations, loss of earnings and to set up a care regime.

Additional Information about Head Injuries

It's important that certain precautionary steps are taken to determine the type of head injury and to exclude other injury such as a brain injury. All head injuries require immediate assessment, regardless of their apparent severity due to the potentially significant effects they can have. We recognise the important distinctions to be made when assessing how to proceed with your case and when determining the type of interim and future assistance you might require.

Following medical assessment and treatment, people are generally discharged from hospital along with head injury advice. Key elements of advice include:

Head Injury Symptoms to look for

  • Drowsiness.
  • Worsening headache that doesn’t go away with Paracetamol.
  • Confusion, unusual behaviour, problems speaking or being understood.
  • Vomiting.
  • Loss of use of part of the body e.g. weak arm or leg.
  • Fitting/seizures or collapse followed by a strange feeling.
  • Visual problems e.g. blurred or double vision.
  • Blood or clear fluid leaking from the ear or nose.
  • Unusual breathing.

Types of Head Injury

A head injury is any type of trauma that leads to an injury of the scalp, skull or brain. For brain injury information please see our dedicated brain injury claims page. Visible wounds are one indication of head injury however, it is important that any forceful contact with the head is investigated to determine if an injury not readily visible has been sustained. Any head injury should be monitored as symptoms can develop over a number of hours. There are 3 main types of head injury:

  • Concussion: This the most common and minor type of head injury. It is important to monitor symptoms of concussion; any deterioration in an individual’s level of response can signify compression of the brain and lead to a more severe brain injury.
  • Open: This type of head injury normally results when pressure or force is applied to the head which is strong enough to cause a fracture or displacement of the skull. An open head injury relates to the breaking of the skull through to the brain but does not necessarily include a brain injury.
  • Closed: This type of head injury refers to an injury to the head which does not affect the structure of the skull, i.e. the skull does not fracture.
