Family’s Compensation Victory after Driver Jailed for Pensioner’s Death
The children of a Liverpool pensioner knocked down and killed a year ago can ‘begin to move on with their lives’ their lawyer has said, after settling a civil claim just weeks after the driver responsible was jailed for more than five years.
Hugh Windrow, of Fazakerley, was knocked down as he walked along the A580 East Lancashire Road in Norris Green on November 16 last year. After spending more than a month in hospital in a critical condition - during which time his family visited him every day - the retired butcher sadly died from his injuries just a week before Christmas.
Last month, 47-year-old Colin Unsworth was sentenced to five years and three months in prison after earlier pleading guilty to causing the death of the 78-year-old by dangerous driving. The court heard how Unsworth had a documented history of issues with drugs and admitted using heroin and crack cocaine the day before the incident.
Now just four weeks later, the family’s civil claim against the driver’s insurance company has been settled for a five figure sum. Slater and Gordon Personal Injury Solicitor Richard Crabtree said, “We are obviously pleased to settle the case on behalf of Mr Windrow’s family, but this was a tragedy that simply need not have happened. Mr Windrow had just been walking home, and his life was taken from him because of the reckless actions of one individual.
“The family’s sudden loss of their loved one was then compounded by the ongoing problems and delays in the process of bringing the driver responsible to justice,” he said. “Although Mr Windrow succumbed to his injuries in December, further post mortem examinations meant the family was unable to hold his funeral until two months later. Similarly, although the driver finally pleaded guilty and has now been sent to prison, there were several delays for adjournment which just served to prolong the family’s suffering.”
Mr Crabtree, a specialist in serious and fatal accident cases, said the settlement would help Mr Windrow’s three children pay the various costs incurred since their father’s tragic death.
“The family was clear that they wanted to fight for justice and hold to account all those who were responsible for the terrible ordeal they have been subjected to,” said Mr Crabtree. “We hope that if any good at all can come from this tragic case, it is that it serves as a stark reminder that a lack of care and attention on the road can cause the death of others and also the destruction of lives.
“Now that the case has settled, the family can finally begin to try to move on with their lives, as they continue to mourn the loss of their beloved father.”
