The Mesothelioma Act 2014 Explained

Asbestos-related illness like fatal Mesothelioma have killed thousands of people in the UK. Sadly many thousands more will die in the years to come.

Slater and Gordon believe that victims of Mesothelioma are entitled to the very best care, advice, support and compensation; and we are determined they will get it.

The Mesothelioma Bill finally gained royal assent and is now an Act of Parliament (Mesothelioma Act 2014). Slater and Gordon Lawyers worked with MPs to campaign for the best deal for victims including writing amendments which were tabled in the House of Commons.

Compensation will be paid by the new scheme to Mesothelioma victims who are unable to bring a case for compensation because either they cannot trace their employer or the employers’ insurer.

Mesothelioma compensation payments will be funded by a 3% levy on active employers' liability insurers. Successful applicants will receive 75% of the average compensation of Mesothelioma victims of the same age who have pursued civil compensation claims.

The scheme will apply to all Mesothelioma victims diagnosed after July 2012.

Slater and Gordon Asbestos Lawyer Patrick Walsh said “The scheme is certainly a step in the right direction but there can be no moral justification for Mesothelioma victims receiving only a percentage of the compensation they are entitled to.

“Under the Government’s new Mesothelioma scheme they will be penalised because, through no fault of their own, they are unable to trace their previous employers or insurers.

“Further whilst this new law provides some compensation for Mesothelioma victims diagnosed after July 2012 it ignores the thousands of victims who have died before this arbitrary cut-off date.

“It's regrettable that the government has not taken a firmer line with the insurance industry which over the years have always done as much as they can to reduce the Mesothelioma compensation paid out sufferers.”

We are determined victims and families deserve the very best from legislation. 

We also fear that calls by the insurance industry to radically change the process for Mesothelioma claims, currently under consideration by the Ministry of Justice, could restrict victims and their grieving families getting the justice they deserve.
