Fatal accident to lead to damages claim
A family could launch a personal injury compensation claim after a loved one passed away during a fatal accident at work.
Richard Kenny died at the age of 48 in October 2006 when a truck overturned on top of his mini digger as he worked on a construction project to build the Waltham Centre for Pet Nutrition in Melton Mowbray.
At the time of this incident, Mr Kenny was driving his vehicle around the site when a lorry delivering 20 tonnes of aggregate unexpectedly overturned when it ran into uneven ground.
The professional passed away instantly and an investigation conducted by the Health and Safety Executive (HSE) found that both contractor JH Hallam and Mr Kenny's employer J & H Construction had failed to properly assess risks on the premises.
Frances Bailey, inspector at the HSE, commented: "Workplace transport should be managed on any site. This death could have been prevented if deliveries had been properly planned."
