Man paralysed in road accident to get compensation
A man who suffered serious injuries in a road accident has won the right to make a full injury compensation claim.
David Tolley got out of his vehicle on the M53 - which is located in the Wirral - to help a female motorist who had crashed into the central reservation.
As he attempted to move her car to the hard shoulder, he was struck by two cars that failed to see him.
Due to the force of the impact, he was thrown 35ft across the road and sustained a broken spine, fractured ribs and punctures to his lungs.
The 46-year-old now faces living the rest of his life as a paraplegic.
His insurers had argued that he would not receive full compensation because the incident was partly his fault.
However, a judge has now ruled that he was not to blame and was performing an act of bravery.
Mr Tolley will be able to take his case forward, although the sum he will receive has not yet been decided.
