Clinical Negligence Compensation Awarded to Boy Born with Cerebral Palsy

A mother has secured compensation for her son for an avoidable accident at birth that left him in need of care for the rest of his life.

The High Court has ordered the United Lincolnshire Hospitals NHS Trust to pay substantial damages to a young boy with cerebral palsy. Suzanne Adams was in labour when she was admitted to Lincoln County hospital in 2002. Midwives proceeded to ignore or misinterpret the CTG trace, which detects fetal heart rate. This, combined with the failure to perform a Caesarean section promptly, caused delays to James’ delivery, resulting in him being starved of oxygen.

Suzanne’s son, James, now 12, was born with cerebral palsy due to Lincoln County hospital’s clinical negligence. His mother pursued a clinical negligence compensation claim on his behalf, arguing that James’ condition would have been avoided if the hospital staff had acted appropriately and delivered him sooner.

It is reported that Ms Adams’ compensation claim will be a minimum of £14.6 million. The sum will cover the costs of disability equipment, therapists, 24 hour live-in carers, modifications to the home so James can use his powered wheelchair, equipment to lift James from his bed and wheelchair, a wheelchair-adapted vehicle and educational funds. Ms Adams spoke of how the clinical negligence compensation will help James realise his potential, commenting, “It was difficult to cope on my own at first and the interim payments my solicitor obtained transformed our lives. But no amount of money can ever make up for the mistakes that have condemned my amazing son to a lifetime of dependency on others.”
