The Benefits of a Fixed Fee Divorce

The issue of legal costs of Divorce was back in the press this week. Mr Justice Holman was hearing the case of Chai v Peng, where the divorce costs to date are £1.6 million.

The wife lives in a £30 million property in Hertfordshire and issued divorce proceedings in the UK. Her costs alone for the preliminary proceedings were £920,000. The husband lives in Malaysia.

The Judge urged both parties to act reasonably before the ‘appalling further litigation gets further out of control’.

The Court are yet to decide which country should hear this divorce case, with the wife’s costs for a one day hearing being an eye watering £55,000. Whilst the costs of divorce need to be proportionate to the case, it's often possible to lose sight and get lost in litigation.
