Allegedly, Standard Innovation collected sensitive data relating to customer’s use of the We-Vibe vibrator via a mobile app, paired with the device. According to the US lawsuit, the data collected included times of use, settings, vibrations intensity levels, temperature of the device and more. This data was linked to customers personal email addresses, making it possible to identify the customers.
In the UK, sensitive and personal information must be processed fairly and lawfully in accordance with the Data Protection Act. Data relating to an individual’s sexual life is considered sensitive and cannot be collected without the explicit consent of that individual. Consumers that we have spoken to simply had no idea that their use of the device was being monitored and the data captured and maintained. If data has been collected in the way alleged, this would constitute a clear breach of the Data Protection Act.
