Our Client

Our client, Mrs V, fractured her hip following an accident whilst playing table tennis on board a cruise travelling around New Zealand. She slipped on a puddle of water that had accumulated due to a leaking roof which had seeped in rain water. A warning sign was put in place the next day.

As a result of the accident, Mrs V was hospitalised in New Zealand where her hip was operated on following a stay in the ICU.

The process of the claim

Upon liaising with the cruise company, with a view to making a claim under the Athens Convention, liability was admitted. As the limitation of claims on board a ship are 2 years, court proceedings were issued, to protect Mrs V’s position given that medical evidence was ongoing.

Settlement offers went back and forth between the parties, with our client ultimately accepting the defendant’s further increased offer of £22,500 a couple of months before trial. This was a considerable settlement that Mrs V was very pleased with and which will allow her some closure and to move on from this accident.
