Settlement following slipping accident in Rhodes

Our client

Our client, Sharon, fractured her left arm following an accident on her hotel balcony, whilst on holiday in Rhodes. As she walked on to her balcony, our client slipped on rainwater. There was a lack of lighting and this issue had already been reported to the hotel upon our client’s arrival. There was also considered to be a problem with the drainage, as water was pouring onto the balcony from an outlet from the roof.

As a result of the accident, Sharon was hospitalised whilst away and her arm was operated on when she was back in the UK, around 3 months after the accident, when a plate was inserted.

Upon liaising with the tour operator Defendant, with a view to making a claim under the Package Travel Regulations, liability was denied. Court proceedings were issued, to protect Sharon’s position, given limitation was 3 years in this case.

Settlement offers went back and forth between the parties, with Sharon ultimately accepting the Defendant’s further increased offer the month before trial. This was a considerable settlement that Sharon was very pleased with and which will allow her some closure and to move on from this accident.
