Successfully represented a claimant during her lifetime and subsequently for her husband following her death due to mesothelioma, caused by past asbestos exposure. This was a complex case. The claimant believed she had been exposed to asbestos during her work as a nurse at the local hospital from about 1980 onwards. However, her recollection of specific exposure was poor. Nevertheless, after substantial detailed investigations we obtained evidence of exposure from former workers at the hospital and also through freedom of information requests for disclosure of documentation. Supportive medical evidence was obtained from a pathologist and chest physician. After commencement of Court proceedings, liability was conceded and the case then settled quickly for £187,000 compensation.
Successfully represented the wife following an Inquest into her husband’s death which was found to have been caused by Mesothelioma due to past asbestos exposure. There was no evidence available from the deceased about his past asbestos exposure. Detailed research and investigation resulted in us obtaining detailed witness evidence confirming probable negligent exposure to asbestos during his employment with Newcastle City Council in the 1970`s as a maintenance and repair worker on council properties.
After disclosure of witness statement and supporting medical evidence the council’s insurers admitted liability. This asbestos case settled for £250,000 compensation. This included a substantial sum to compensate the widow for the loss of her husband’s care, assistance and other services. She was more than usually dependant because of her own mild epilepsy.
