A claim celebre - by Child Abuse Lawyer Liz Dux

Sometimes we receive cases that truly shock the public; sometimes they challenge perceptions of a celebrated individual or a well thought of institution; sometimes it is all of these at once, in a single claim. The allegations surrounding Jimmy Savile are serious, and horrific in their detail and scale. Police are currently investigating, at the time of writing, some 340 lines of enquiry regarding alleged sexual offences, with many complainants making reference to events that occurred in their early teens.   Slater & Gordon have been contacted by a number of the victims of Jimmy Savile, to explore how the BBC and the NHS may be held vicariously liable for Saviles wrong doing. We feel there is a compelling case to be made. Although the Jimmy Savile case is unusual in many ways, given the public nature of the claim, one thing that makes it similar to many civil cases are the questions it prompts what are the claimants motivations? The simple answer to this question is often not one many people expect it is not the money. Indeed in the many abuse cases I have worked on, despite the payouts we have secured, money is never the priority. Rather victims are searching for recognition, for comfort, for an acknowledgement of what has happened to them and what should never happen to others.  Securing justice has always been about more than simply receiving a payout: our courts are more than judicial holes in the walls. It is right that when people have been let down, they have the opportunity to gain recompense and feel that justice has been done, no matter the institution at fault, the age or nature of the claim, the availability or fame of the defendant. These factors might well make gaining justice more difficult, but they do not make it any less essential for healing process.
