Our Human Rights Solicitors represent pupils and students with learning difficulties or disabilities who are experiencing problems in their education in England & Wales.
At Slater and Gordon Lawyers we understand that everyone learns differently and in different ways, but we believe everyone is entitled to a good standard of education, regardless of any learning difficulties or disabilities they may have.
We understand the difficulties, prejudice and confusion that are often faced by people with disabilities when seeking education and support services, and we are here to ensure they receive the education they deserve.
The term 'Special Educational Needs' refers to children who have learning difficulties or disabilities that make it harder for them to learn than most children of the same age.
Whilst many children with Special Educational Needs have access to appropriate support at school, sadly, there are many who don’t. This means that it is sometimes necessary for parents to seek the support their child needs by voicing their concerns with the school involved.
These attempts are not always successful however and if further action is necessary our Human Rights Solicitors can help challenge poor assessments and decisions in regard to children with disabilities and Special Educational Needs.
If matters cannot be resolved by way of negotiation or mediation, there is a Special Educational Needs and Disability Tribunal. This is designed to deal with such disputes and parents’ appeals about Special Educational Needs plans and decisions.
The Special Educational Needs and Disability Tribunal is structured so that parents can represent themselves. We understand that this can be daunting for some people. As such, we can offer expert legal advice to better prepare you for a hearing, and we can also provide expert legal representation at the hearing.
Our Human Rights Solicitors have all the necessary knowledge and expertise in disability rights, care, support and education law cases to provide the legal advice, assistance and advocacy you need if your child experiences difficulties at school or in the community due to their disabilities or special educational needs.
Some children with Special Educational Needs or disabilities can face difficulties obtaining a place at their preferred school. Slater and Gordon Lawyers can help parents with appeals to the Independent Admissions Appeal Panel, either offering parents’ legal advice before Panel hearings or by providing an expert Humans Rights Solicitor to represent you at the hearing.
More than two-thirds of all permanently excluded children have Special Educational Needs. A school’s decision to exclude a child is one that should never be taken lightly and government guidance emphasises the importance of schools considering alternatives to exclusion wherever possible, particularly where children with Special Educational Needs (SEN) are concerned. This means that any decision to exclude children must take into account all relevant information about each particular child.
In the event that a child is excluded from school, the Local Education Authority (LEA) is obliged to minimise any disruption to their studies by ensuring that adequate education at home or in an alternative school environment is provided. Parents are entitled to challenge exclusion decisions by firstly complaining to the school. If no progress is made and you still disagree with the decision, there may be grounds to appeal further.
If your child has been excluded for a fixed term or permanently due to their SEN or any other disability they may have, we may be able to help you. There are strict time limits in which to appeal. If you would like to challenge an exclusion decision, call freephone 0800 916 9046 and ask to speak with a Human Rights Solicitor or contact us online and we’ll be happy to help you.
Schools have a duty to prevent all forms of bullying. If your child has special educational needs or disabilities and you believe they are being bullied at school, you are entitled to lodge a formal complaint. If your child’s school refuses or fails to deal with the issue, our Human Rights Solicitors can help you in liaising with the school and/or pursuing further action to ensure the problem is dealt with as quickly as possible.
If you are enrolled at College or University and experiencing problems with your studies due to a learning difficulty or disability, call Slater and Gordon Lawyers.
Depending on your course or what stage you are with your studies, there are different paths you can take to resolve any issues you may have.
Initially, you can pursue matters through your education provider’s complaints procedures. If this fails to resolve the issue/s you can also contact an independent organisation such as the Office for the Independent Adjudicator. Slater and Gordon Lawyers can help you deal with any problems you may face and offer expert legal advice or representation in England & Wales.
There any many funding options available depending on your particular case including No Win No Fee. Your Human Rights Lawyer will advise you of the options.
