Slater & Gordon Lawyers are investigating the potential mis-selling of card payment facilities sold to a large range of businesses by First Data apparently acting for Bank of Scotland Merchant Services. This may have caused those businesses to incur substantial losses. 

The selling of and the terms of contract of these card payment collection facilities may have been contrary to FSA regulatory provisions as well as the overreaching legal requirements. Affected customers may have been approached by First Data sales teams from 2007 onwards and advised to move from their current providers on the basis that the Bank of Scotland Merchant Services facility was a better deal.

The new contracts may have contained a right to vary the contract terms which was triggered to raise the cost. Further there appears to have been a delayed payment arrangement applied which meant that payments to businesses were delayed beyond an expected 4 days.
